Terms of Service

1. What Crewable does
Crewable is a software service that sends automated text messages and emails on your behalf — for example, replying to missed calls, chasing invoices, and requesting reviews from customers you've worked with. We provide the technology; you remain the sender of every message and are responsible for its content and recipients.
2. Who can use it
You must be at least 18 years old and operating a legitimate service business in the United States. By signing up, you confirm that the information you provide is accurate and that you have authority to bind the business you're registering on behalf of.
3. Your account
Keep your login credentials secure. You're responsible for anything that happens under your account. Tell us at support@getcrewable.com if you suspect unauthorized access.
4. Your responsibilities around SMS (important)
This section describes obligations that reduce your legal risk — read it carefully.
Crewable sends messages through carriers regulated under the U.S. Telephone Consumer Protection Act (TCPA), CAN-SPAM, and equivalent state laws. Because you decide who receives messages and when, you are the sender under those laws. By using Crewable, you agree that:
- You will only contact people who have a lawful basis to receive messages from you — typically prior express consent, an established business relationship, or a number they voluntarily provided in the course of a service request.
- You will not use Crewable for unsolicited marketing, bulk prospecting, collections, or any purpose outside the scope of your own service business.
- You will honor opt-outs. Crewable automatically suppresses a recipient after they reply STOP, UNSUBSCRIBE, CANCEL, or similar, but you're responsible for keeping your own contact records current.
- You will not configure Crewable to impersonate anyone other than your own business.
- You indemnify us for claims arising from messages you send — see Section 11.
5. Acceptable use
You won't:
- Use Crewable for anything illegal, harassing, deceptive, or harmful.
- Send unsolicited bulk marketing, spam, or commercial content unrelated to your service relationship.
- Attempt to reverse engineer, scrape, overload, or circumvent our systems.
- Share login credentials to let additional users access your account outside the seats your plan permits.
- Resell, sublicense, or rebrand Crewable without our written permission.
We can suspend or terminate accounts that violate this section without refund.
6. Free trial, billing, and cancellation
- Free trial: new accounts get a 14-day free trial. No payment method required to start.
- Billing: after the trial, your chosen plan (Contractor $39/month or Team $129/month) is billed monthly to the payment method you provide. Prices are in USD and exclusive of any applicable taxes.
- Cancellation: you can cancel at any time from Settings. Your subscription stays active until the end of the current billing period, then stops — you won't be charged again. We don't offer pro-rated refunds for partial months.
- Price changes: we may change prices with at least 30 days' notice. Changes apply to your next billing period.
- Failed payments: if a charge fails, we'll retry for a few days. If it keeps failing, the account moves to suspended and, eventually, is deactivated.
7. Your content and data
The customer records, job notes, and message templates you put into Crewable are yours. You grant us a limited license to store, process, and transmit them solely for the purpose of providing the service. We don't use your data to train AI models, sell it, or share it outside the subprocessor list in our Privacy Policy.
When you cancel, your data is kept for up to 90 days in case you reactivate, then deleted or anonymized. You can request earlier deletion at any time.
8. Our intellectual property
Crewable's software, design, brand, and documentation belong to us. Nothing in these Terms transfers ownership of those things to you. We grant you a non-exclusive, non-transferable license to use Crewable for the duration of your subscription.
9. Third-party services
Crewable relies on third-party services (Twilio for SMS, Stripe for payments, Anthropic for AI, Supabase for hosting, Google for review links). Outages, errors, or policy changes at those providers can affect Crewable. We aren't liable for their failures, but we'll work in good faith to mitigate issues and communicate status.
10. Warranty disclaimer
Crewable is provided "as is" and "as available". We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the service will be uninterrupted, error-free, or that every message will be delivered.
11. Limitation of liability
To the fullest extent allowed by law, Crewable's total liability for any claim arising from the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business.
12. Indemnification
You agree to defend, indemnify, and hold Crewable harmless from claims, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the service, (b) your violation of these Terms, (c) your violation of any law (particularly TCPA, CAN-SPAM, or consumer protection statutes), or (d) content, messages, or data you submit through Crewable.
13. Termination
You can terminate at any time by cancelling your subscription. We may terminate or suspend your account if you violate these Terms, fail to pay, or if we reasonably believe continued service creates legal risk. On termination, your license to use Crewable ends and we'll handle your data per Section 7.
14. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of laws. Any dispute arising from these Terms or the service will be resolved in the state or federal courts located in Wyoming, and you consent to the exclusive jurisdiction of those courts. Nothing here prevents either party from seeking equitable relief (such as an injunction) where appropriate.
15. Changes to these Terms
We may update these Terms from time to time. If changes are material, we'll notify you by email and post a notice on the site at least 14 days before they take effect. Continued use of the service after changes take effect means you accept the updated Terms.
